Privacy Policy

This Privacy Policy explains what information Smackagram collects, how we use and share it, how long we keep it, and the choices available to customers and call recipients. It applies to smackagram.com and the services offered through it. Our Terms & Conditions govern use of the Service.

1. Information We Collect

Account information. We collect information you provide when creating or using an account, including your name, screen name, email address, mobile telephone number, date of birth, login information, and account-verification records.

Payment information. Payments are processed by a third-party payment provider. Smackagram receives transaction and account-balance information but does not store or have access to your complete payment-card number.

Content and recipient information. We collect the content and sports-related inputs you provide or select, including recipient names and telephone numbers, teams, games, topics, tone settings, triggering outcomes, final scripts and audio, Smack Cards, and other generated content. If you use Auto-Smack, we collect its recipient, game, team or teams, trigger, activation, result, generation, and delivery information. If you use SmackCast or connect another service, we may collect the fantasy-league, sports-account, or social-media information needed to provide the requested feature.

Acceptance and compliance records. We may record the account identifier, version, displayed text, date, and time associated with acceptance of our Terms and acknowledgment of this Privacy Policy; account-verification consent; optional recurring SMS/MMS consent; call-specific representations; preview, rejection, regeneration, approval, activation, and final-send events; and moderation or safety-control results.

Technical and delivery information. We automatically collect information such as IP address, browser type, device information, pages visited, timestamps, provider call identifiers, call status and duration, answer and disconnect events, playback status, delivery results, and opt-out or suppression records. If an interactive call feature is offered in the future, we may also record keypad inputs needed to operate that feature or honor an opt-out.

Smackagram does not record, store, or provide access to a recipient's voice or reaction.

2. How We Use Information

We do not use recipient telephone numbers obtained for Smack Calls to market Smackagram or another product to the recipient.

3. Recipient Information and Opt-Outs

Customers provide recipient information and represent that they personally know the recipient and are authorized to contact them. Smackagram uses recipient information to provide the requested Service, enforce safety controls, prevent repeated or prohibited calls, respond to complaints, and comply with law.

A recipient may permanently block future Smack Calls by submitting the form at smackagram.com/opt-out or contacting support@smackagram.com. No account is required. An opted-out telephone number is added to a platform-wide suppression list that applies to every customer and cannot be overridden.

We retain suppression-list information for as long as necessary to honor the permanent block, including after other information may be deleted. We do not use a suppressed number for marketing.

4. Mobile Numbers and SMS/MMS Messages

Smackagram operates separate transactional and optional recurring messaging programs. Consent to one does not constitute consent to the other.

Account verification. When you provide a mobile number and request a verification code, you consent to receive a transactional security text required to verify your account. Message and data rates may apply. Reply STOP to block future texts or HELP for assistance. Blocking texts may prevent verification; contact support@smackagram.com for help.

Optional recurring messages. You receive recurring SMS/MMS messages only after checking an optional consent box that is unchecked by default. Messages may include order or service updates, delivery confirmations, and links to requested Smackagram content. Message frequency varies, and message and data rates may apply. Consent is not required to create an account or make a purchase. Reply STOP to unsubscribe or HELP for assistance. Carriers are not responsible for delayed or undelivered messages.

We record the applicable consent or opt-out event, displayed text or version, account or mobile number, and timestamp. Mobile information and SMS consent are not sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

5. How We Share Information

We do not sell personal information for money. We do share limited information with advertising partners for advertising measurement and targeting, which some state privacy laws treat as “sharing” or as a “sale.” Section 6 explains exactly what is shared and how to turn it off.

We share information with service providers only as reasonably necessary to operate the Service. These may include providers of telecommunications and messaging, payment processing, cloud hosting and storage, artificial-intelligence and voice generation, sports or fantasy data, analytics, customer support, and social-media functionality. Providers may process information only for the services they perform for Smackagram, subject to applicable agreements and law.

If you choose to connect or publish through a third-party service or social-media platform, information is shared at your direction and is also governed by that third party's terms and privacy policy.

We may disclose information when required by law; to investigate fraud, abuse, threats, or violations; to protect the rights, safety, and property of Smackagram or others; or in connection with a merger, financing, reorganization, sale, or transfer of all or part of the business, subject to applicable law.

6. Cookies, Advertising, and Your Privacy Choices

Smackagram uses cookies and similar technology. Some are strictly necessary — they keep you signed in, hold your cart and wallet state, and protect against fraud — and the Service does not work without them.

We also use advertising technology, including the Meta Pixel and Meta’s Conversions API, to measure whether our advertising works. When this is active, we may share the following about the person holding the Smackagram account: a securely hashed version of the account email address, a securely hashed internal account identifier, the IP address and browser user-agent of the visit, Meta’s own advertising cookie identifiers if present, the page visited, and generic transaction details such as the product purchased, the amount, and the currency.

We never share information about a Smack recipient for advertising. No recipient name, telephone number, email address, or address; no team, player, or game selection; no roast text, audio, transcript, or intensity setting; and nothing else about the person a Smack is directed at is ever provided to an advertising partner. Advertising information identifies only the customer who registered or paid.

We do not provide payment-card numbers, passwords, or authentication credentials to advertising partners.

How to turn advertising sharing off. Visit Do Not Sell or Share My Personal Information and opt out. No account is required, the choice takes effect immediately, and it does not affect your ability to buy, send, or receive anything. Because the choice is stored in a cookie on the browser you use, it applies to that browser and device.

Global Privacy Control. If your browser or extension sends a Global Privacy Control (GPC) signal, we treat it as a valid request to opt out of advertising sharing and honor it automatically, without any action on this site.

Turning off advertising sharing does not stop Smack Calls. To block calls to a telephone number permanently, use the methods in Section 3. To stop text messages, reply STOP.

7. How Long We Keep Information

We retain account information while an account is active and for as long afterward as reasonably necessary for the purposes described in this Policy. Generated content may be retained so the customer can access account history and so Smackagram can document the content authorized and delivered.

Terms versions, acceptance records, call-specific confirmations, final scripts and audio, Auto-Smack settings, provider call records, delivery events, opt-outs, and related compliance records may be retained after account closure for as long as reasonably necessary to document compliance, resolve disputes, enforce agreements, protect users, and meet legal obligations.

Suppression-list information may be retained indefinitely so a permanent recipient opt-out remains effective. When information is no longer reasonably needed, we delete or de-identify it as appropriate.

8. Your Choices

You may contact us to request access to, correction of, or deletion of your personal information, or to close your account. We may retain information that is reasonably necessary to honor a recipient opt-out, protect security, prevent fraud or abuse, document compliance, resolve disputes, enforce our agreements, or satisfy legal obligations.

You may withdraw optional recurring SMS/MMS consent at any time by replying STOP. Withdrawing optional messaging consent does not affect your account or ability to purchase the Service. If you connected a third-party service, you may disconnect it through the available account or provider settings.

Call recipients may use the opt-out methods described in Section 3.

9. Children

Smackagram is not intended for anyone under 18, and the Service may not be used to send content to a person under 18. We do not knowingly collect personal information from children. If you believe a child provided personal information, contact us so we can investigate and delete it where appropriate.

10. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Changes and Contact

We may update this Privacy Policy and will identify the effective date of each version. For material changes, we will provide reasonable notice and, where appropriate or required, request a renewed acknowledgment or consent.
